How to Make an Offer on an Abu Dhabi Property: The MOU and Deposit Explained

Put the offer, property identity, funding conditions and deposit handling in writing before agreeing to an Abu Dhabi home purchase.

Knownable Research · · 6 min read · Updated

An offer is more than a price. It proposes a particular home, parties, financing position, timing and conditions. Once a document or deposit is involved, small ambiguities can become expensive. This guide helps you ask the right questions before you sign or pay.

The aim is a buyer's document review workflow, not a prediction of contract outcome. The agreed terms and the responsible authority matter more than a generic template.

Put the actual proposal in writing

Identify the property precisely enough to avoid confusion between buildings, phases or units. Record the proposed price, included items, occupancy assumptions, funding method and date by which the proposal is open.

Ask which party has authority to respond on the seller's behalf. If an agent is involved, request their professional details and check the relevant official record. ADREC's directory, inspected on 2 October 2026, has profession name and licence number search fields. This review did not verify a particular person. A missing result requires clarification, not an accusation.

Do not assume a spoken offer is always without legal effect, or that a messaging exchange is automatically a final sale contract. The effect of a communication depends on its actual wording and circumstances. Keep dated copies and get advice if the status of an accepted proposal matters.

Read the MOU as the document you may actually sign

A memorandum of understanding can record the parties' intentions and transaction terms, but the label does not settle its legal effect. Have a qualified adviser explain the actual wording before signing.

QuestionDetail to find in the draft
Who is involved?Exact buyer and seller identities and signing authority
What is being discussed?Property reference, included items, occupancy and existing obligations
What is agreed?Price, currency, proposed payment stages and cost allocation
What remains conditional?Financing, property evidence, approvals and any other express condition
When must it happen?Dates, notice method, extensions and what happens if a step is late
How can a dispute arise?Deposit custody, default allegations, refund and dispute process

Do not rely on a copied template to fill a missing answer. Ask how the procedure applies to the exact property's registration jurisdiction and status. A ready resale and an off plan purchase may involve different documents and payment controls.

The offer preparation guide addresses price ceiling and funding presentation; this page focuses the document and money handling.

Locate the deposit before paying it

Ask for the proposed amount and why that amount was chosen. No universal ten percent deposit is established by the sources checked here. A mathematical example can illustrate scale without creating a market rule: ten percent of a fictional AED 1,000,000 price is AED 100,000. That does not tell you what you should pay.

Before issuing any payment, record the named recipient, bank or cheque payee, holder, permitted use, release triggers, refund process and evidence of receipt. Ask who can instruct the holder and what happens if parties disagree. Do not assume a broker, seller or another party automatically provides neutral custody.

Off plan project payments may use regulated escrow arrangements. This guide does not extend a developer escrow rule to a resale deposit. Verify the specific project and payment route with the responsible authority before paying.

If financing is required, have the actual condition address what happens when a lender declines, reduces or delays funding. A calculator result is not approval. The mortgage preapproval guide explains how to record outstanding lender conditions.

Separate registration charges from other costs

ADREC's published registration legislation, checked on 2 October 2026, includes a Schedule of Fees under Resolution 49 of 2018. The sale entry says the Executive Committee determines a percentage between one and four percent and describes equal division between seller and buyer unless otherwise agreed. That published text does not by itself confirm the current exact charge, exemptions or allocation for a particular transaction.

Request a dated itemized calculation from the correct authority or adviser. Confirm separately any brokerage commission, developer administration charge, lender charge or optional service cost and who has agreed to pay it. Do not assume a flat registration figure or automatic buyer payment.

The relevant fee rule and registration channel can depend on the property and current procedure. Do not use a Dubai form or another property's invoice as the basis for your Abu Dhabi budget.

Check documents through the right service

Ask an appropriate professional how to confirm the seller's authority, title reference, existing mortgage or restriction and the route to transfer. A public market dashboard is not a title search.

ADREC's document verification page, inspected on 2 October 2026, lists tenancy contracts, certificates and Madhmoun permits. Its listed categories do not prove that it verifies every possible title, seller identity or transfer document. Use the service only for a document type it actually covers and confirm any other check with the responsible registry.

A requested no objection certificate, service charge clearance or mortgage settlement can affect the sequence, but this guide does not claim one identical list for every property. Put the required documents and parties beside their actual deadlines.

Stop before an unsupported promise

Ask a qualified adviser to review the draft deposit and exit terms before you sign, pay or send a notice. Do not assume a seller's withdrawal always triggers compensation or a buyer's withdrawal always forfeits the same amount. Those outcomes need the applicable law, wording and facts.

Record any change to the agreed proposal through the required method and confirm who must receive it. A verbal assurance about a refund or deadline is a question to resolve in the document, not a substitute for one.

The practical goal is a traceable offer and an understood payment route. This is general education, not legal, financial, tax or valuation advice.

Frequently asked questions

Is a ten percent deposit required for every Abu Dhabi purchase?

This guide found no basis for a universal amount. Ask what is proposed for your transaction, when it becomes payable, who holds it and how it would be returned or released. Have the signed terms reviewed before paying.

Is every document called an MOU legally binding in the same way?

No universal conclusion can be drawn from the label alone. The wording, parties, property and circumstances matter. Obtain qualified advice on the actual draft before assuming it has no effect or that signing automatically creates one specific obligation.

Will I always get my deposit back if financing fails?

This guide establishes no automatic refund. Examine the financing condition, proof and notice requirements, deadlines and payment handling with a qualified adviser before committing or withdrawing.

What transfer fee should I budget?

Get a dated itemized quote from the responsible registration authority and transaction adviser. The published ADREC fee schedule describes a range and allocation rule, not a confirmed charge for this purchase. Distinguish it from brokerage, developer administration and optional service charges.
